As a tenant or business owner using Business Connect, you are the sole Data Controller for all personal data you collect, store, and process regarding your customers, staff members, and any other individuals within your Business Connect account. This includes, but is not limited to, names, contact information, service history, financial details, and any other data you input into the platform. Business Connect (the platform provider) acts strictly as a Data Processor on your behalf. We process data only according to your instructions and our Terms of Service. You are solely responsible for:

  • Obtaining all necessary consents from your customers and staff.
  • Ensuring the data you collect and process complies with all applicable privacy laws (e.g., GDPR, CCPA, PIPEDA, PIPA, etc.).
  • Responding to data subject requests (e.g., access, rectification, erasure) from your customers and staff.
  • Implementing your own privacy policy that accurately reflects your data practices as the Data Controller.

Business Connect, as the platform provider, does not collect, control, or have direct access to your customer or staff data for its own purposes. Our privacy policy pertains to how we handle data related to your use of our platform, not how you handle your customer's and staff's data.

1. Introduction

Welcome to Business Connect ("we," "our," or "us"). We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our business management platform and related services (collectively, the "Service"). Please read this policy carefully. If you disagree with its terms, please discontinue use of the Service.

2. Information We Collect (As a Platform Provider)

We collect information directly from you (the tenant/business owner), not from your customers or staff:

  • Account Information: Your name, email address, phone number, and business details when you register or create a Business Connect account.
  • Billing Information: Payment details processed securely through our payment processor (Stripe). We do not store full credit card numbers.
  • Identity Verification: Government-issued identification and tax information required for compliance purposes related to your business account.
  • Usage Data: Log data, IP address, browser type, pages visited, and interactions with the Business Connect platform itself. This helps us understand how you use our service to improve it.
  • Device Information: Hardware model, operating system version, and unique device identifiers of your devices used to access Business Connect.

3. How We Use Your Information (As a Platform Provider)

We use the information we collect from you (the tenant) to:

  • Provide, operate, and maintain the Business Connect Service.
  • Process your transactions and send related information, including purchase confirmations and invoices for your Business Connect subscription.
  • Send administrative information such as changes to our terms, conditions, and policies.
  • Respond to your comments, questions, and requests and provide customer support for the Business Connect platform.
  • Send promotional communications about Business Connect features or updates (you may opt-out at any time).
  • Monitor and analyze trends, usage, and activities in connection with the Business Connect Service.
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities related to your Business Connect account.
  • Comply with legal obligations.

4. Your Business Data on Business Connect (Tenant as Data Controller)

As a tenant, you may upload or input personal data concerning your own customers and staff into our platform. This data includes:

  • Customer records (names, contact info, service history)
  • Staff information (names, roles, schedules, payroll data)
  • Appointment details
  • Invoices and financial records
  • Any other data relevant to your business operations

Business Connect acts solely as a Data Processor for this "Business Data." This means:

  • We process this data only on your instructions as the Data Controller.
  • We do not use this data for our own purposes (e.g., we do not market to your customers).
  • You retain full ownership and control over your Business Data.
  • You are responsible for the legality of collecting, storing, and processing this data, including obtaining necessary consents and complying with all applicable data protection laws.

5. How We Share Your Information (As a Platform Provider)

We do not sell your personal information (as the tenant). We may share your information in the following circumstances:

  • Service Providers: With third-party vendors who assist in providing and maintaining the Business Connect Service (e.g., payment processors like Stripe, cloud hosting providers, email delivery services like Resend, SMS services like Twilio, AI/LLM providers for specific features if enabled by you).
  • Legal Requirements: If required by law or in response to valid requests by public authorities.
  • Business Transfers: In connection with a merger, acquisition, or sale of Business Connect assets.
  • With Your Consent: In any other circumstances where you have provided explicit consent.

6. Data Retention

We retain your personal information (as the tenant) for as long as necessary to provide the Business Connect Service and fulfill the purposes outlined in this policy, unless a longer retention period is required by law. When you delete your Business Connect account, we will delete or anonymize your personal information within 30 days, except where retention is required for legal obligations. Your Business Data (customer and staff information) is retained according to your instructions and our Terms of Service. Upon termination of your Business Connect account, your Business Data will be deleted or anonymized as per our data retention policies and legal requirements.

7. Data Security

We implement appropriate technical and organizational security measures to protect your personal information (as the tenant) and your Business Data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption in transit (TLS/SSL), secure cloud infrastructure, access controls, and regular security audits. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8. Google Sign-In

Our Service offers sign-in via Google. When you use Google Sign-In, we receive your name, email address, and profile picture from Google as permitted by your Google account settings. We use this information solely to create and manage your Business Connect account. We do not access any other Google account data without your explicit consent. Your use of Google Sign-In is also governed by Google's Privacy Policy.

9. AI/LLM Usage

Some features within Business Connect may utilize Artificial Intelligence (AI) and Large Language Models (LLMs) to enhance functionality (e.g., content generation, data analysis). If you choose to use these features, any data you submit to these AI models will be processed by third-party AI service providers. We ensure that these providers adhere to strict data privacy and security standards. As the Data Controller, you are responsible for ensuring that the use of AI features with your Business Data complies with your own privacy policies and legal obligations.

10. SMS and Other Communications

Business Connect facilitates various communication channels, including email and SMS, for you to interact with your customers and staff.

  • SMS: If you enable SMS features, we use third-party SMS providers (e.g., Twilio) to send messages on your behalf. We transmit only the necessary data (phone numbers, message content) to these providers to execute the service.
  • Email: If you use email campaign features or transactional emails, we use third-party email providers (e.g., Resend) to send messages on your behalf.

As the Data Controller, you are responsible for obtaining appropriate consent from your customers and staff for all electronic communications, including SMS and email, and for managing their opt-in/opt-out preferences.

11. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track activity on the Business Connect Service and store certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. If you do not accept cookies, some portions of the Service may not function properly.

12. Children's Privacy (Clarification for Daycare/Child-related Businesses)

The Business Connect platform itself is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 directly from the platform users (tenants). However, if you, as a tenant, operate a business such as a daycare, child services, or any other business that involves collecting personal data of children (including those under 13), you may input such data into the Business Connect platform. In such cases:

  • You (the tenant) are the sole Data Controller for all children's data.
  • You are solely responsible for complying with all applicable laws and regulations concerning children's privacy (e.g., COPPA, GDPR-K, etc.), including obtaining verifiable parental consent where required.
  • Business Connect acts strictly as a Data Processor for this children's data, processing it only according to your instructions.
  • If you become aware that a child has provided us with personal information directly (as a tenant of Business Connect), please contact us so that we can take appropriate action.

13. Tenant Data Isolation

Business Connect is a multi-tenant platform. This means that each tenant's Business Data (customer and staff information, financial records, etc.) is logically separated and isolated from other tenants' data. We implement technical and organizational measures to ensure that your Business Data is accessible only to you and your authorized users, and is not shared with or exposed to other tenants.

14. Your Privacy Rights (As a Platform User/Tenant)

Depending on your location, you may have the following rights regarding your personal information (as a Business Connect tenant):

  • Access: Request a copy of the personal information we hold about your Business Connect account.
  • Correction: Request correction of inaccurate or incomplete information related to your Business Connect account.
  • Deletion: Request deletion of your personal information and Business Connect account, subject to certain exceptions.
  • Portability: Request a machine-readable copy of your Business Connect account data.
  • Objection: Object to the processing of your personal information for certain purposes.
  • Opt-Out: Opt out of Business Connect's marketing communications at any time via the unsubscribe link in emails.
